Terms & Conditions


If any of our product is not 100% satisfactory, simply return it within 30 days for full credit refund of purchase or exchange less the shipping fee. A 25% restoking fee may apply on furniture & equipments. All returned furniture and equipment must be in original packaging. Fee may increase on damaged or used equipment. All credits in your account are automatically deducted from your next order. Claims for missing items must be received 24 hours from receipt of order.

WARRANTY ON ALL EQUIPMENT
1 Year warranty from date of invoice.
Warranty for Malfunction & Manufacturer's defect only ( parts, labor & shipping not included). THIS WARRANTY IS VOID IN THE EVENT EQUIPMENT IS DAMAGED BY IMPROPER USE. This Warranty DOES NOT COVER malfunction and/or manufacturer's defects discoverable upon reasonable inspection on date of delivery, unless Warranty holder (1) submits photograph of defect or damage taken no later than date of delivery; and (2) reports defect or damage to Company within 24 hours of date of delivery.Notwithstanding anything to contrary herein stated, this Warranty DOES NOT apply to any malfunction or manufacturer's defect unless Warranty holder: (1) obtains a return authorization number issued by Company; (2) ships damaged or defective product to Company under that authorization number together with original packaging and tracking number of carrier pursuant to which equipment was originally delivered; (3) pays all costs associated with return shipment of equipment to Company; (4) pays Company a restocking charge of twenty five percent (25%) of the invoice price (inclusive of any and all costs and expenses incurred by Company in packing, shipping transporting or otherwise delivering replacement equipment to Customer). The company will issue company credit only for returns. No refunds. IN THE EVENT OF CHARGEBACKS OR STOP PAYMENTS, THIS WARRANTY IS VOID.RECEIVING
RECEIVER MUST BE PRESENT UPON ARRIVAL OF MERCHANDISE. ANY DAMAGE DUE TO SHIPPING, PLEASE DO NOT REMOVE ITEMS FROM THE ORIGINAL PACKAGING AND MUST BE REPORTED TO SPA MANUFACTURER DIRECT. PHONE # 800-715-5751.
ANY CLAIM OR DAMAGE NOT REPORTED WITHIN 24 HOURS WILL NOT BE HONORED.TERMS & CONDITONS OF PURCHASE

ORDERS: California Sales Tax is required to be assessed on all product or equipment purchases made in California, an on all orders shipped to an address within California. All orders $200.00 or more must be paid by cashier check, money order or credit card unless other terms apply. Returned checks will be charged $50.00. All orders will be shipped by UPS unless otherwise specified. No next day, 2nd day, or 3rd day delivery method will be used, unless requested by and paid by the customer. There is an additional $8.00 charge for any COD orders. Order processing time is 5-10 business days for all shipments in the United States. Cancellations are subject to a 25% cancellation fee. No cancellations after 24 hours from purchase.

RETURNS/ REFUSALS: There is a 25% restocking fee for all returns. The company will issue company credit only for returns. No Refunds. All Returns must be done within 7 working days of invoice. All returns items must be in the same condition and in the same packaging as it was received. It must not be used assembled or damaged in any manner. All Returns must be pre-approved with a valid return authorization number placed outside the box. Returns without return authorization number will be refused. Any merchandise shipped by the client who is damaged during shipping will be the responsibility of the shipper. We reserve the right to make exceptions to this based on situation, carrier or client.

DAMAGES/ DEFECTS: Damage/ Defective products must be reported within 24 hours of receipt of merchandise. Client must have the original tracking number of the carrier in order to process the damage complaint. Damage complaints without original packaging and tracking will not be entertained. Replacements will be sent out upon confirmation & receipt of the original damaged item. Only items with manufacturing defects or with damages due to improper shipping will be replaced. Damages due to improper use of the equipment are not eligible for replacement. We reserve the right to make exceptions to this to base on situation, carrier or client.TERMS & CONDITIONS MAY CHANGE WITHOUT PRIOR NOTICE. WE RESERVE THE RIGHT TO REFUSE SERVICE TO ANYONE.

ALL SALES & PRICES ARE FINAL.

The enclosure of these application instructions is not intended to serve as a representation or warranty that the application of the equipment in conformity with these instructions will achieve the desired outcome or any particular result. All such warranties and representations are hereby expressly disclaimed. This equipment has been sold to, and is designed to be applied only by a licensed aesthetician; and adherence to these application instructions is not a substitute for, and does not excuse the licensee from, his/her professional obligation to independently assess the risk that the application of the equipment will cause an adverse skin reaction or other injury, in light of the consumer’s general health and skin condition.

Sales Policies
1 SDS Spa and Salon Equipment does not accept responsibility for installation or assembly of any items purchased.
2 SDS Spa and Salon Equipment is not responsible for maintenance of any of our products. Proper use and maintenance are the sole responsibility of the customer.
3 SDS Spa and Salon Equipment is not responsible nor has knowledge of individual building codes or laws. Please check with your local government offices regarding any questions that you may have. Compliance with all local, state and federal codes is the sole responsibility of the customer.

Payment Policies
1 All purchases must be prepaid. We accept Visa, MasterCard, American Express, Discover, Certified Bank Checks and Money Orders. SDS Spa and Salon Equipment also is certified with many different lenders that can provide our customers with many different financing options. COD’s are not accepted.
2 Special order items, as well as items that are not in stock, will require a 50% deposit with the balance due prior to delivery or pick up of merchandise. Items that remain in our warehouse must be picked up or shipping within 3 weeks of purchase. Customer will be charged storage fees of no less than $55 per day that item(s) are held in our facilities.
3 After special orders are in production, the customer is fully responsible for paying the balance. If the order is cancelled, it will result in total forfeiture of deposit.
4 All returned checks will be charged an additional $35 plus all bank and services charges.

Shortages, Damages or Loss of Items in Transit
1 All shortages or damages must be reported within 24 hours of receipt of merchandise. Problems reported after 24 hours are not the responsibility of SDS Spa and Salon Equipment and resolution of the problems are not guaranteed.
2 Any damages to products are the sole responsibility of the carrier and such damage claims are between the SDS Spa and Salon Equipment and carrier. The customer is required to provide video evidence of the damage so that SDS Spa and Salon Equipment can file a claim and send replacement merchandise to the customer.


Exchanges, Returns & Refunds
1 All returned products will incur a 25% restocking/reconditioning fee.
2 All merchandise must be returned in its original box with original packing materials and must be packed in such a manner that it will not incur damages in return transit. Any damages to returned products are the sole responsibility of the customer and such damage claims are between the carrier and customer.
3 Refunds and exchanges will be given within 30 days from the original date of purchase. All credits for merchandise will be given as in-house credit only.
4 Custom orders CANNOT be returned for any reason whatsoever.
5 All refunds issued will be less shipping charges. Customers are responsible for all return shipping charges.
6 All returns must be approved by SDS Spa and Salon Equipment before they are returned and must be accompanied by an RMA number.

Limitations of Warranty
1 Hydraulic pumps are covered by a 1/2 year limited warranty, electronic items are covered by a 180 day limited warranty and all other items are covered by a 1 year limited warranty.
2 SDS Spa and Salon Equipment shall not, under any circumstances, be liable for abuse, misuse, normal wear and tear, alteration, improper maintenance, unauthorized repair, design concepts, any chipping, fading or peeling of laminate or any acts of nature, such as, fire, water damage, freeze, etc.
3 SDS Spa and Salon Equipment reserves the right to replace any discontinued item with a like or similar item.
4 A licensed plumber must perform all installation for plumbing and all plumbing related equipment. Failure to do so will result in the warranty being voided. Documentation must be provided to SDS Spa and Salon Equipment for all plumbing related warranty issues.
5 All transit costs for items returned to SDS Spa and Salon Equipment or replaced by SDS Spa and Salon Equipment is the sole responsibility of the customer.
6 An approved electrician must service all equipment still under warranty. Failure to do so will result in the warranty being voided.
7 Any reconditioned, open box and floor models are sold as is and do not include a warranty unless otherwise noted by SDS Spa and Salon Equipment

CREDIT CARD PAYMENT ACCEPTANCE AGREEMENT
SDS Spa and Salon Equipment (the “Seller”), the person listed as purchaser in the sale order (the “Purchaser”) and the credit card holder (the “Credit Card Holder”)  hereby enter into this credit card payment acceptance agreement (the “Agreement”), based on the following recitals, terms and conditions:
RECITALS

  1. WHEREAS, Credit Card Holder desires to purchase merchandise from Seller (the “Merchandise”), for his/her/its own account, or for the account of Purchaser, and desires to pay for the Merchandise by charging all or a part of the purchase price to a credit card;
  2. WHEREAS, the aggregate purchase price of the Merchandise is in the sale order/invoice (the “Purchase Price”);
  3. WHEREAS, the credit card (the "Credit Card") issued by issuer (ie. American Express, MasterCard, etc.) (the "Issuer"), bearing the number given to Seller is a valid credit card held by Credit Card Holder; and
  4. WHEREAS, Seller is willing to accept payment of the Purchase Price for the Merchandise by way of a charge against the Credit Card only upon the following terms and conditions.

NOW, THEREFORE, the parties agree as follows:

  1. Joint and Several Obligations. Unless Credit Card Holder is purchasing the Merchandise for his/her/its own account, Purchaser and Credit Card Holder (Credit Card Holder and/or Credit Card Holder and Purchaser together hereinafter collectively referred to as the "Buyer") jointly and severally agree to all of the terms and provisions of this Agreement.
  2. Sale and Purchase Agreement.  Buyer agrees to purchase the Merchandise from Seller and Seller agrees to sell the Merchandise to Buyer and accept Buyer's payment of all or a portion of the Purchase Price in the form of a charge in that amount against the Credit Card (collectively, the "Credit Card Payment").
  3. Acceptance of Merchandise. Without waiving Buyer's rights, if any, under Paragraph 6.d. of Seller's standard terms and conditions ("Seller’s Standard Terms and Conditions"), a copy of which is located on Seller’s website and catalogue, and a link to which is provided below, in consideration for Seller's acceptance of the Credit Card Payment, Buyer hereby agrees to accept the Merchandise upon delivery, forever waiving its right to revoke its acceptance of the Merchandise at a later date.
  4. No Charge-Back. In further consideration of Seller's acceptance of the Credit Card Payment, Buyer hereby agrees that Buyer will not request, demand or otherwise cause the Issuer, or any company providing credit card charge processing services to the Issuer, to reverse and/or charge-back the Credit Card Payment to the merchant account of Seller (a "Charge-Back").
  5. Effect of Charge-Back. Without thereby diminishing any other remedies available to Seller in law or equity, in the event of a Charge-Back, Buyer agrees (i) that all obligations of Seller, either expressly provided or implied by Seller's Standard Terms and Conditions, are fully discharged; (ii) that all risk of loss and/or damage to the Merchandise, including damage the Merchandise may have suffered in transit from Seller to Buyer, is allocated to Buyer; (iii) that Buyer accepts and acknowledges its ownership and retention of the Merchandise in its AS-IS, WHERE-IS condition as of the date of the Charge-back; and (iv) that Buyer shall personally transmit to Seller, certified funds in the amount of the Charge-Back, within 15 calendar days of the mailing date of Seller's demand notice to Buyer.
  6. Arbitration. Any and all disputes and/or controversies concerning this Agreement, including the purchase of Merchandise by Buyer, shall be resolved exclusively by binding arbitration under the auspices of ADR Services, Inc., located at 1900 Avenue of the Stars, Suite 250, Los Angeles, California 90067. The arbitration award shall include an award of reasonable attorney's fees and costs to the prevailing party, and shall be enforceable in any court of competent jurisdiction.
  7. Jurisdiction.  This Agreement is subject to and shall be construed and enforced in accordance with the laws of the State of California.
  8. Attorney's Fees. In any proceeding brought to enforce the terms of this Agreement, the prevailing party shall be entitled to recover attorney’s fees.

By purchasing Merchandise from Seller, Buyer agrees to the terms and conditions listed in this Agreement and in Seller’s Standard Terms and Conditions.
